Minimum Advertised Price (MAP Policy)

MAP Basics

Advertising is the means by which customers understand the value of a product. To encourage dealers to help establish the value and premium nature of SW-MOTECH products, SW-MOTECH USA maintains a Minimum Advertised Price (MAP). This pricing can be found on the most current Dealer Price list or by visiting www.sw-motech.us. Unless otherwise stated and notified directly from SW-MOTECH USA, all current product offerings are covered by the MAP policy. It is important to remember that the MAP policy is the only document on which all compliance will be based, and it supersedes all other communications. SW-MOTECH USA may, at its sole discretion and without notice, modify products, prices and these guidelines.

Scope of Policy

This policy prohibits all Dealers of SW-MOTECH products from advertising at below the MAP, internationally, or at wholesale. Further, the policy applies to advertising of all SW-MOTECH products by Dealers in any external media including, but not limited to radio, television, internet websites, forums, and/or auction sites, email, and print in any form, such as direct mailings, catalogs, price lists, flyers, group faxing, group emailing, and tradeshow signs and brochures. This policy applies strictly to advertised prices and will not in any way restrict the Dealer’s ability to determine its own resale prices. The policy is not intended to prohibit any Dealer from providing below MAP quotations on an individual basis in response to a specific request for quotation by an individual customer; provided such response is not automated and is given by person-to-person communication. The phrase “Call for Price” may be used to alert potential customers that the actual selling price differs from MAP. Phrases such as “We offer the Best Prices”, “We’ll Beat any Offer”, “No Reasonable Offer Refused”, “Prices Slashed”, “The Cheapest Prices Available”, “Price Too Low to Print”, “New Low Price” or other phrases similar in wording, tone, or intent, are not permitted in any advertisement medium. The following practices will also be treated as violations of the policy, on the basis that they violate the spirit of the policy:

Use of any rebate, discount, coupon, promotion, giveaway, loyalty program or incentive in any advertising by a Dealer where the cumulative effect is to reduce the advertised price of any SW-MOTECH Product below its MAP.

The use of “click on” or “click through” buttons on a website, or any similar buttons, group discount systems, keyed discount codes, or automated price quotation transmission feature to provide automatic price quotations at below the MAP for any SW-MOTECH Product.

Adherence to the MAP guidelines apply to the advertisement of closed box SW-MOTECH product only. (Used, refurbished, demonstration or dealer-reconditioned units do not apply as long as they are advertised as such.)

Sales Via Third-Party Marketplaces.

Dealer will only sell products within URLs listed in their dealer application and approved by SWMOTECH USA. Dealer will not sell products on or through any third-party site (Amazon, eBay, Walmart.com, etc.) without prior written consent for that specific marketplace and storefront URL from SW-MOTECH USA. SW-MOTECH USA holds the right to revoke its consent at any time without advance notice

Products Acquired for Resale.

Upon purchasing SW-MOTECH products for resale through SW-MOTECH USA or an authorized distributor of SW-MOTECH USA products, dealer acknowledges and understands SW-MOTECH USA’s MAP Guidelines. All products listed must be sold directly to the end user. Any unauthorized movement of products to another non-authorized dealer, exporter, or another unauthorized organization is a violation of MAP policy.

Complying with the MAP Guidelines:

We try to keep the MAP guidelines as easy to understand and adhere to as possible. By following important points listed throughout this document, your advertising efforts will remain in compliance with the MAP program.

A departure from MAP may result in disciplinary action such as loss of your ability to participate in incentive programs, bonus programs, discount purchase offers, or any other promotion or offering, a departure from this policy can result in a stop of delivery on any open order, all disciplinary action is at the discretion of SW-MOTECH USA.

A Review of Your Ad is Available to Help Ensure MAP Compliance:

To make it easier for you to create product ads that meet the MAP guidelines, SW-MOTECH USA offers a free service to review your advertising before placement. This service, available to all SW-MOTECH USA dealers, checks proposed advertising for compliance with MAP.

One of the key advantages of the approval service is that you will not be liable for violations if your advertising materials were approved by SW-MOTECH USA and were published as approved.
